Terms and Conditions
Leisure Pools South Africa ("Leisure Pools") manufacturers fibreglass pools and distributes its pools through independent retailers and/or licensed agents (the "Agents"). Each Agent is an independent contractor and the relationship between Leisure Pools and any Agent shall never be deemed or construed to be one of employer-employee, a partnership, joint venture, or anything similar that may be deemed or construed to make leisure Pools co-responsible or co-liable for any undertaking given, service or product provided, or work undertaken by any Agent. No Agent has any authority of any kind whatsoever to create any binding obligation on the part of Leisure Pools, or any partner or affiliate of Leisure Pools. Leisure Pools Agents are independently registered companies which have been granted licences to trade under the Leisure Pools banner, but do not have the authority to act for on behalf of Leisure Pools.
Leisure Pools has no control, whether direct or indirect, over any Agent's employees, contractors, sub-contractors and/or agents and dealers that install its pools, and each Agent has the sole right to control and direct its employees, contractors, sub-contractors and/or dealers with in its licensed areas.
Leisure Pools's obligation concerning any pools manufactured by it is limited solely to its 10-year Structural Warranty. Leisure Pools shall accept no responsibility or liability whatsoever with respect to the installation of its pools, which installation or repair is performed at the discretion of any independent Agent or dealer or any of such Agents' contractors or sub-contractors that sold and/or installed the pool. Leisure Pools disclaims any and all liability for any act or omission on behalf of any Agent or any Agent's contractors or sub-contractors.
Leisure Pools manufactured pools are not designed for use with any diving equipment, and no diving board and quick entry devices are to be installed for use with a Leisure Pools Pool RSA.
PLEASE ENSURE THAT ANY AGENT CLAIMING TO BE A LEISURE POOLS AGENT IS, IN FACT, SUCH A DULY LICENSED AGENT BY EMAILING info@leisurepools.co.za. |
